Terms of Use

1. Acceptance of Terms

By accessing or using EnQuote, you confirm that you have read, understood, and agree to be bound by these Terms of Use (“Terms”). If you are accepting these Terms on behalf of a company or organisation, you represent and warrant that you have the authority to bind that entity to these Terms.

These Terms are updated from time to time. Continued use of EnQuote following notification of an update constitutes acceptance of the revised Terms. Users will be notified of updates upon login when changes are made.

If you do not agree to these Terms, you must immediately cease using EnQuote and contact us at support@leaptech.sg.

2. Eligibility and Account Registration

EnQuote is intended for use by individuals who are 15 years of age or older. By using EnQuote, you represent and warrant that you meet this age requirement.

To access EnQuote, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the confidentiality of your account credentials including your username and password
• Accept responsibility for all activities that occur under your account
• Notify Leaptech immediately at support@leaptech.sg if you suspect any unauthorised use of your account or any other breach of security

Leaptech reserves the right to refuse registration, suspend, or terminate any account at its sole discretion.

3. Definitions

“Users” means individuals fifteen years or older who are authorised to access and use EnQuote under a valid Subscription.

“EnQuote” means the cloud-based business management suite productivity application provided by Leaptechnology Pte Ltd and the underlying servers and software used to provide such application.

“Leaptech” means Leaptechnology Pte Ltd, a Singapore corporation and service provider of the EnQuote application.

“User Data” refers to any personally identifiable information input by Users into EnQuote in the normal course of usage.

“Operational Data” refers to transactional and business data generated through the use of EnQuote, including quotation amounts, item-level pricing, cost figures, work categories, area classifications, and project types. Operational Data may include User Data where such data contains personally identifiable information.

“Subscription” means the right to access EnQuote during the agreed term.

“Office Hours” means Monday to Friday, 9:00am to 6:00pm Singapore Standard Time, excluding Singapore public holidays.

“Content” means any data, text, information, documents, graphics, or other materials uploaded, submitted, or generated through EnQuote by Users.

4. Use of EnQuote

EnQuote is provided as a software tool to facilitate and streamline business operations including quotation generation, sales management, invoicing, and customer relationship management.

Users agree to use EnQuote only for lawful purposes and in accordance with these Terms. Users must not use EnQuote in any way that breaches applicable laws or regulations, is fraudulent, or causes harm to Leaptech or third parties.

Leaptech reserves the right to suspend or terminate access to EnQuote with immediate effect if a User is found to be acting inconsistently with these Terms or engaging in fraudulent, immoral, or illegal activities.

5. Prohibited Uses

You agree not to use EnQuote to:

• Violate any applicable local, national, or international law or regulation
• Transmit any unsolicited or unauthorised advertising or promotional material
• Knowingly transmit any data or material that contains viruses, Trojan horses, worms, or any other malicious or harmful programs
• Attempt to gain unauthorised access to any part of EnQuote, its servers, or any system or network connected to EnQuote
• Interfere with or disrupt the integrity or performance of EnQuote or the data contained therein
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of EnQuote
• Copy, modify, distribute, sell, or lease any part of EnQuote or its content without prior written consent from Leaptech
• Use EnQuote to store or transmit infringing, libellous, or otherwise unlawful or tortious material
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Use EnQuote in any manner that could damage, disable, overburden, or impair Leaptech’s servers or networks

6. Reference Documents and System Records

The Client acknowledges that printed or digital outputs generated through EnQuote, including but not limited to PDF documents, quotation printouts, invoices, credit notes, free-of-charge documents, Variation Orders, and any other system-generated reports or documents, are reference documents only and do not supersede the signed contractual documents or Leaptech’s system records, which shall at all times serve as the sole authoritative and binding reference.

The Client further acknowledges that certain items may be calculated as bundled or aggregated amounts and may not appear as individual line items in any output. Neither discrepancies between outputs and system records, nor the absence of individually itemised amounts, shall constitute grounds for any claim, demand, or dispute against Leaptechnology Pte Ltd.

7. Client Responsibilities

The Client remains solely responsible for:

• Verifying the accuracy of all quotations, invoices, financial calculations, and business documents generated through EnQuote before presenting them to customers or third parties
• All business decisions, quotations, pricing strategies, and commercial transactions made using EnQuote
• Maintaining the confidentiality of EnQuote account credentials and all activities occurring under the account
• All content created during usage of EnQuote including textual information, imagery, and audio recordings
• Ensuring that their use of EnQuote complies with all applicable laws and regulations

8. Technical Support

Leaptech’s technical support obligations are limited to Office Hours. Leaptech shall not be obligated to respond to, act upon, or be bound by any support request received outside of Office Hours, including requests via telephone, WhatsApp, email, or any other channel.

Any response or assistance provided outside of Office Hours is made strictly on a goodwill basis at Leaptech’s sole discretion and shall not:

• constitute a variation of Leaptech’s support obligations
• create any expectation or entitlement to future out-of-hours support; or
• be construed as an acknowledgement of any urgency, liability, or obligation on Leaptech’s part

Repeated out-of-hours requests may, at Leaptech’s discretion, be subject to additional charges at rates to be separately agreed in writing.

9. Changes to the Service

Leaptech reserves the right to modify, suspend, or discontinue EnQuote or any part thereof at any time, with or without notice. This includes adding, modifying, or removing features, functionality, or content.

Leaptech shall not be liable to you or any third party for any modification, suspension, or discontinuation of EnQuote or any part thereof, except as expressly provided in these Terms.

In the event of permanent discontinuation of EnQuote, Leaptech shall provide at least ninety (90) days’ written notice to affected clients.

10. Third Party Links and Services

EnQuote may contain links to third party websites, services, or integrations that are not owned or controlled by Leaptech. Leaptech has no control over and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party websites or services that you visit or use through EnQuote.

Leaptech shall not be liable for any loss or damage arising from your use of any third party websites, services, or integrations accessed through EnQuote.

11. Indemnity

The User agrees to indemnify and hold harmless Leaptechnology Pte Ltd, its subsidiaries, officers, directors, employees, and agents from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• The User’s use of or inability to use EnQuote
• The User’s violation of these Terms or any applicable law or regulation
• Any quotation losses, sales losses, lost business opportunities, pricing errors, calculation mistakes, or financial discrepancies arising from the use of EnQuote
• Any claim by a third party arising out of the User’s use of EnQuote
• Any Content submitted, posted, or transmitted through EnQuote by the User
• Any breach of the User’s responsibilities as set out in Section 7

This indemnity survives termination or expiration of these Terms.

12. Disclaimer of Warranties

EnQuote is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Leaptech expressly disclaims all warranties including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that EnQuote will meet your requirements or be available on an uninterrupted, timely, secure, or error-free basis
• Any warranty as to the accuracy, reliability, or completeness of any information obtained through EnQuote
• Any warranty that defects in EnQuote will be corrected

No advice or information, whether oral or written, obtained by you from Leaptech or through EnQuote shall create any warranty not expressly stated in these Terms.

Your use of EnQuote is at your sole risk.

13. Limitation of Liability

In no event shall Leaptechnology Pte Ltd, its subsidiaries, officers, or employees be liable, whether in contract, warranty, tort (including negligence), or any other form of liability for special, indirect, consequential, or incidental damages, including but not limited to loss of profits, revenues, data, or business opportunities, suffered as a result of the use of or inability to use EnQuote.

Leaptech shall not be liable for any damage suffered by the User arising from the use or inability to use EnQuote; messages received or transactions entered into through EnQuote; unauthorised access to or alteration of the User’s transmissions or data; or any failure, interruption, error, or loss arising from third party services, integrations, platforms, or infrastructure used in connection with EnQuote, including cloud hosting providers, payment gateways, telecommunication services, or third party APIs.

Notwithstanding any other provision of these Terms, Leaptechnology Pte Ltd’s total aggregate liability to the Client — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall in no event exceed the total fees paid by the Client to Leaptechnology Pte Ltd in the three (3) calendar months immediately preceding the event giving rise to the claim. This cap applies to all claims in aggregate and not to each individual claim separately.

Nothing in these Terms is intended to exclude or restrict liability which cannot be limited or excluded by law.

14. Intellectual Property

All title, ownership, and intellectual property rights in and to EnQuote and all copies thereof are owned by Leaptechnology Pte Ltd. All rights are reserved. EnQuote is protected by copyright laws, international copyright treaties, and other applicable laws.

Unauthorised reproduction, modification, distribution, transmission, republication, display, or performance of EnQuote or any part thereof is strictly prohibited.

Nothing in these Terms grants you any right to use Leaptech’s trade names, trademarks, service marks, logos, or domain names without our prior written consent.

15. User Data and Privacy

The collection, use, and protection of your personal data is governed by Leaptech’s Privacy Policy, which forms part of these Terms. By using EnQuote, you agree to the terms of the Privacy Policy.

16. Aggregated Data and Benchmarking Insights

By using EnQuote, you acknowledge and agree that Leaptech may collect, aggregate, and analyse Operational Data generated through your use of EnQuote for the purpose of producing anonymised, aggregated benchmarking insights (“Benchmarking Data”).

The collection of Operational Data for benchmarking purposes forms part of the service provided under your Subscription and is a purpose for which you provide consent by agreeing to these Terms. The anonymisation process through which Benchmarking Data is produced removes all personal data as defined under the Personal Data Protection Act 2012 (PDPA). Once anonymised, Benchmarking Data does not constitute personal data and falls outside the scope of the PDPA. To the extent that any personal data is processed prior to anonymisation, such processing is carried out in accordance with the business improvement purpose exception under the PDPA (First Schedule, Part 5) and is limited to what is reasonably necessary for the production of anonymised statistical insights.

Benchmarking Data may be used to provide features such as:

• Industry-wide or category-level pricing averages, medians, and percentile ranges
• Indications of whether a User’s quotation, pricing, or margins fall above, below, or within typical ranges for comparable work types, areas, or project categories
• Trend analysis showing how pricing and costs change over time across the platform
• Recommended pricing ranges based on historical data for similar scope of work

All Benchmarking Data is derived from anonymised and aggregated records across multiple accounts. Leaptech will never disclose, sell, or make available any individual User’s raw data, identifiable pricing, client details, or proprietary business information to any other User or third party.

Leaptech employs the following safeguards to protect User confidentiality:

• No Benchmarking Data will be generated or displayed for any category or segment where the sample size is fewer than five (5) distinct companies, to prevent re-identification
• All data points are stripped of identifying information — including company name, client names, project addresses, and contact details — before aggregation
• Benchmarking insights are presented as statistical summaries only (e.g. averages, percentiles, ranges) and never as individual data points

Benchmarking Data is provided for informational and reference purposes only. It does not constitute financial, professional, or pricing advice. Users remain solely responsible for their own quotation pricing, commercial decisions, and business strategy. Leaptech makes no warranty as to the accuracy, completeness, or applicability of any Benchmarking Data to the User’s specific circumstances.

Leaptech applies the principle of data minimisation to the benchmarking process. Only the minimum categories of Operational Data necessary to produce meaningful statistical insights are processed, and no personal data (such as names, contact details, or client information) is included in the aggregation pipeline.

Leaptech reserves the right to use Benchmarking Data internally for product improvement, research, and development of new features.

If you do not wish for your Operational Data to be included in the aggregation process used to generate Benchmarking Data, you may notify Leaptech in writing at support@leaptech.sg. Upon receiving such notice, Leaptech will exclude your account’s data from future benchmarking aggregations within thirty (30) days. Opting out of benchmarking aggregation will not affect your access to or use of EnQuote’s other features, but you may not receive certain benchmarking insights that require participation in the aggregation pool.

Users agree not to attempt to re-identify, de-anonymise, or reverse-engineer any Benchmarking Data to determine the identity, pricing, or business information of any other User or their clients.

Leaptech will periodically review its anonymisation techniques and minimum threshold requirements to ensure they remain effective against re-identification risks, taking into account advances in technology and data analytics methods.

17. Suspension and Termination

Leaptech reserves the right to suspend or terminate your access to EnQuote at any time, with or without cause, and with or without notice. Grounds for suspension or termination include but are not limited to:

• Breach of these Terms
• Fraudulent, immoral, or illegal activity
• Non-payment of Subscription fees
• Actions that harm Leaptech, other users, or third parties

If you wish to appeal a suspension or termination, please contact us at support@leaptech.sg within 14 days of receiving notice. Leaptech will review appeals at its sole discretion and its decision shall be final.

Upon termination, your right to use EnQuote ceases immediately. A 30-day grace period applies during which your account data may be recovered. Thereafter, your data will be archived or deleted in accordance with our Privacy Policy.

18. Force Majeure

Neither party shall be liable for failure to perform under these Terms resulting from causes beyond its reasonable control, including acts of God, acts of governmental authorities, terrorism, natural catastrophe, fire, flood, riot, war, or power failure.

19. General

These Terms constitute the entire agreement between the User and Leaptechnology Pte Ltd with respect to the use of EnQuote and supersede all prior understandings and agreements regarding the same subject matter.

Any claim or cause of action arising out of or related to the use of EnQuote must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Any waiver, alteration, or modification of these Terms shall not be valid unless in writing and signed by both parties. Leaptech’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute shall be subject to the exclusive jurisdiction of the courts of Singapore.
